This role requires a bright and dynamic leader with strong subject matter expertise in the call center and life insurance sectors. They will be responsible for the delivery of contract writing and compliance laws to the Company at all levels of the organization, including:
Providing advice and guidance for the various insurance lines with a focus on contracts and compliance; marketing and claims.
JOB DUTIES AND RESPONSIBILITIES:
DNC and TCPA versed.
Develop and maintain active relationships with business and functional partners to understand and adequately support the business in achieving its goals;
Work collaboratively with peers across all functions as well as with all levels of staff to ensure philosophical consistencies of approach and practice across diverse business lines;
Maintain and grow in-depth knowledge of the business
Support customer, regulator and distributor facing units in resolving and re-mediating disputes with respect to product, servicing and market conduct;
Draft, review and negotiate a broad range of non-insurance commercial contracts; and,
Monitors, and as necessary, coordinates compliance activities of other departments to remain abreast of the status of all compliance activities and to identify trends.
Identifies potential areas of compliance vulnerability and risk;
corrective action plans for resolution of problematic issues, and provides general guidance on how to avoid or deal with similar situations in the future.
Monitors the performance of the Compliance Program and relates activities on a continuing basis, taking appropriate steps to improve its effectiveness.
Acts as an independent review and evaluation body to ensure that compliance issues/concerns within the organization are being appropriately evaluated, investigated and all appropriate corrective actions are taken, performs follow up to assure corrective action was taken, and reports results to relevant stakeholders as necessary.
Develops, initiates, maintains, monitors, and revises policies and procedures for the general operation of the Compliance Program and its related activities on a continuous basis to prevent illegal, unethical, or improper conduct. Manages day-to-day operation of the Program taking appropriate steps to improve its effectiveness.
Proactively takes all necessary measures to maintain a competent level of expertise and knowledge and stays abreast of constantly changing federal and state laws and regulations relevant to the U.S. life insurance industry and those applicable to sales and marketing, including but not limited to, those promulgated by the Federal Communications Commission (FCC), the Federal Trade Commission (FTC), and each of the 50 states of the U.S.
Responds to alleged violations of rules, regulations, policies, procedures, and Standards of Conduct by evaluating or recommending the initiation of investigative procedures. Develops and oversees a system for uniform handling of such violations.
Assists as needed with any partner, vendor, or other third party due diligence or security audit requests.
Oversees and ensures AccuQuote and third-party partner websites and other advertising mediums and materials, and all applicable telemarketing and marketing related activities, consistently meet state and federal laws, rules, and regulations, including but not limited to those enacted by CAN-SPAM Act, Telephone Consumer Protection Act, Telemarketing Sales Rule, Gramm-Leach Bliley Act and the federal and state Do Not Call registries.
Develop and maintain standard legal documentation file memos, briefing notes and position papers supporting the Business on any issues arising from the day-to-day activities of the company.
Insurance or call center industry a must, as well as the ability to communicate balancing risk to the organization; Also contract and compliance knowledge.
Financial services, FTC and FCC regulated
DNC educated on all laws; state and federal.
Strong knowledge of marketing and advertisement law and insurance;
Self-starter initiative with the ability to meet and exceed deadlines, prioritize, multi-task, and maintain flexibility in a fast-paced, changing environment;
Ability to see the big picture as well as “roll up your sleeves” to work on matters requiring expertise, attention to detail and execution;
Proven problem-solving skills that demonstrate creativity and commitment to core values;
Solid experience in drafting and negotiating insurance contracts and disclosures;
Strong interpersonal skills;
Call center knowledge;
